미국 최대의 웹 커뮤니티 사이트인 ‘토픽스(topix)’가 유우성 간첩조작사건의 중국 공문서 증거 위조 사건을 다룬 코리아헤럴드의 기사를 올려놓아 이제 이 사건이 전 세계로 급속하게 확산되고 있다.

토픽스는 27일 코리아헤럴드의 ‘Fake evidence scandal hits prosecution, NIS-간첩사건 증거조작 논란에 휩싸인 검찰과 국정원’, ‘Questions mount over secretive investigation inalleged spy case-간첩사건 혐의에 대한 비밀 수사에 대해 의구심 확산’이라는 제목의 기사를 올려놓았다. 이 기사는 첫머리부터 이 사건이 검찰의 위상을 크게 훼손했을 뿐 아니라 대한민국 법제도의 도덕성에 대한 의심조차 들게 만들었다고 직격탄을 날렸다.

2004년 탈북해 한국으로 온 재북화교 출신의 피고 유우성씨는 재판에서 무죄를 선고 받았지만, 검찰은 유씨가 2006년까지 북한을 드나들었다는 사실을 증명하는 것으로 보고된 중국 문서를 새로운 증거로 제시하며 항소함으로써 공문서 위조가 수면위로 드러났다고 밝힌 이 기사는 서울 주재 중국대사관이 이 문서들이 위조된 것을 확인하면서 파장이 갈수록 확대되고 있다고 전했다.

특히 이 기사는 이 사건의 배후에 국정원이 있으며 이 사건으로 국정원이 비난을 받고 있다며 지난 대선 개입 사실도 언급했다. 기사는 ‘검찰의 주장을 뒷받침해 주는 증거가 거의 전무한 가운데, 지난 2012년 대선 이래, 야당후보에게 불리한 여론을 조작하려 했다는 의혹으로 비난에 시달려 온 국정원의 불안한 지위는 이제 악화일로에놓이게 됐다’고 전하며 국정원이 계속해서 신빙성 있는 설명을 못하고 있다고 보도했다. 보수주의자들이국정원을 보호하려는 발언을 하고 있다고 꼬집은 이 기사는 중국대사관이 관련 서류가 위조라고 말한 것에 숨은 의도가 있을 수 있다고 암시하고 있다고전했다.

Hamstrung by allegations of evidence fabrication, the prosecutors’ office is facing a major crisis.

증거조작 의혹으로 발목잡힌 검찰이 큰 위기를 맞고 있다.

The developments that threaten to undermine not only the prosecutors’ office but also cast doubt on the integrity of South Korea’s entire legal system began to play out last year when a former Seoul city official was tried on charges of espionage.

검찰의 위상을 크게 훼손했을 뿐 아니라 대한민국 법제도의 도덕성에 대한 의심조차 들게 만든 이 사건은 작년 전 서울시청 직원이 간첩혐의로 기소되면서 시작됐다.

Although the defendant, Yoo Woo-seong, a North Korean of Chinese descent who came to the South in 2004, was initially acquitted, the prosecution appealed with new Chinese doc-uments allegedly proving that Yoo had traveled to North Korea as late as 2006.

The Chinese Embassy in Seoul, however, has since stated that the doc-uments were forgeries, sending a shock wave that is now amplifying by the day. The prosecution has yet to produce convincing explanations about the true sources of the doc-uments. It has embarked on an internal investigation into possible flaws in the evidence gathered for the Yoo case, but criticism is mounting over its secretive investigation methods, which often raise questions about their motives.

하지만 서울 주재 중국대사관이 이 문서들이 위조되었음을 확인하면서, 이로 인한 파장은 날이 갈수록 확대되고 있다. 검찰은 이 문서들을 입수한 경위에 대해 신빙성 있는 답변을 내놓지 못하고 있다. 유씨 재판 관련 증거입수 과정에서 문제가 있었는지에 대해 검찰이 내부조사에 착수했다고는 하지만, 수사 동기가 무엇인지에 대해 종종 의심을 받곤 하는 비밀적 수사방침에 대한 비판이 커지고 있다.

Prompted by the allegations, the main opposition Democratic Party, which is calling for a major reform of the investigative organization, is ratcheting up the pressure on the prosecutors’ office.

이 의혹이 제기되자, 주요 야당인 민주당은 수사기관의 대대적인 개혁을 요구함으로써, 검찰에 압박을 가하고 있다.

The DP is operating a special committee to get to the bottom of the spy evidence scandal, and its members are said to have found no proof that the doc-uments in question were obtained through official channels at the Shenyang mission on Tuesday.

민주당은 이 간첩조작 사건의 진상을 규명하기 위해 특별 진상조사단을 운영하고 있는데, 화요일의 선양 현지조사에서, 문제의 서류가 공식 경로를 통해 얻어진 것이라는 증거는 찾지 못한 것으로 알려졌다.

The near absence of proof backing up the prosecution’s claims is also undermining the already precarious position of the National Intelligence Service, which has been under fire since the 2012 presidential election for allegedly attempting to sway public opinion against the opposition candidate.

검찰의 주장을 뒷받침해 주는 증거가 거의 전무한 가운데, 지난 2012년 대선 이래, 야당후보에게 불리한 여론을 조작하려 했다는 의혹으로 비난에 시달려 온 국정원의 불안한 지위는 이제 악화일로에 놓이게 됐다.

Although the NIS has compiled a report supposedly proving the doc-uments’ authenticity, the spy agency’s move only appears to be adding fuel to the fire.

국정원이 서류의 신빙성을 입증해줄거라 믿어지는 보고서를 만들긴 했지만 이러한 행동은 단지 불에 기름을 붓는 격으로 보인다.

DP spokesperson Rep. Han Jeoung-ae said Wednesday that the NIS had maintained the authenticity of the doc-uments but suddenly changed its position Tuesday, saying the doc-uments had been obtained through unofficial channels by one of its agents.

수요일 민주당 대변인 한정애는, 국정원이 서류가 진본임을 계속 주장했다가, 화요일 입장이 돌변하여, 국정원 직원 한명이 비공식적인 경로를 통해 서류를 얻었다고 밝혔다고 말했다.

“In other words, it has verified they are not official doc-uments,” Han said.

“즉, 그 서류가 공식서류가 아니란 것을 국정원이 확인한 셈”이라고 한 대변인은 결론지었다.

She added that the prosecution’s investigation into the fabrication scandal might be conducted in a way that protects the NIS, accusing the two organizations of being in “strange cohabitation.”

한 대변인은 문서 조작 스캔들에 대한 검찰의 조사가 국정원을 보호하는 방법으로 진행될 수 있다며 두 기관의 “이상한 공존관계”를 비난했다.

“The truth cannot be hidden by covering up lies with more lies. What else could the prosecution, which adopts unverified, forged evidence, do,” Han said.

“거짓말을 더 많은 거짓말로 덮어서 진실을 숨길 수 없다. 검증되지 않은 위조된 증거를 채택한 검찰이 할 수 있는게 다른 어떤 것이 있을까?” 라고 한 대변인은 말했다.

The conservatives on the other hand are defending the prosecutors’ office and the spy agency, saying that the case concerns China’s counterintelligence activities.

반면 보수주의자들은 검찰과 국정원을 두둔하며 이 사건은 중국의 방첩 활동과 관계 있다고 말한다.

Rep. Yoon Sang-hyun, deputy floor leader of the ruling Saenuri Party, has repeatedly stated that the case involves China’s counterintelligence policies, claiming that Beijing considers local officials providing information to foreign countries as espionage.

여당 새누리당 원내 부대표 윤상현 의원은 여러 번 이 사건이 중국의 방첩 활동 정책과 관련이 있다며, 지역 관리들이 외국에 정보를 제공하는 것을 중국당국은 간첩 활동으로 여긴다고 주장하고 있다.

Yoon also implied that the Chinese Embassy in Seoul may have ulterior motives in saying that the concerned doc-uments were forgeries.

윤 의원은 또한 서울의 중국 대사관이 관련 서류가 위조라고 말한 것에 숨은 동기가 있을 수 있다고 암시했다.

The ruling party lawmaker also attacked the opposition bloc saying “politicians’ reckless sensationalism” was damaging national interests.

여당 국회의원은 또한 “정치인의 무모한 선정주의”가 국익을 해치고 있다며 야당의 연대를 공격했다.
